How we protect, manage, and use your personal data

This Privacy Policy explains how we, Beyondtech or PT Adisena Mitra Usaha (hereinafter referred to as "We" or "Us"), collect, store, use, process, control, transfer, disclose, and protect information and data related to users of our services, including Personal Data, as necessary.

As stated in the Service Agreement, Beyondtech’s services are provided to legal entities and business entities, whether established by a specific deed or otherwise ("Business Entities"). Therefore, information and data other than Personal Data under this Privacy Policy refer to the information and data of each Business Entity registered in Beyondtech’s electronic system, while Personal Data (as defined below) refers to the Personal Data of employees or business representatives of such Business Entities.

This Privacy Policy is prepared in accordance with applicable laws and regulations, including but not limited to Law Number 27 of 2022 on Personal Data Protection and its implementing regulations.

By accessing and/or using Beyondtech’s services, the Business Entity along with its employees or representatives (hereinafter referred to as "You") declare that all information, data, documents, and Personal Data provided are true, complete, and lawful, and You grant consent to Beyondtech to obtain, collect, store, transfer, manage, and use such Personal Data in accordance with this Privacy Policy, the Service Agreement, and the applicable Terms and Conditions ("Consent").

Your Consent remains valid until You withdraw it in writing or, in accordance with Section 13, upon termination of the contractual relationship with Us. If You have any questions regarding the protection or use of Your information and data, please contact Us via email and/or WhatsApp as stated in this Privacy Policy.

1. Data Protection and Confidentiality

1.1. Definition of Personal Data

In this Privacy Policy, "Personal Data" refers to any information that can identify or be used to identify, contact, or locate a person or device associated with such information.

Personal Data includes, but is not limited to: name, address, date of birth, occupation, phone number, email address, bank and credit card details, gender, identity information (including passport or other official identification documents), vehicle information, photographs, nationality, contact lists stored on your mobile device, financial information, and biometric data (including facial recognition).

If other information, including profile information and/or unique identifiers, is combined with or linked to Personal Data, it will also be treated as Personal Data. For the purposes of this Policy, Personal Data applies to individuals who are employees or business representatives of Business Entities using Beyondtech’s services.

1.2. Data Security

We take the security of Your Personal Data seriously and store it on secure servers. All information You provide is stored on protected servers. Payment transactions are encrypted using Transport Layer Security (TLS) technology.

1.3. Security Disclaimer

You understand that no system is completely immune to unauthorized access. Therefore, You agree to release Us from any civil or criminal claims arising from unauthorized access by third parties (if such events occur).

1.4. Password Responsibility

You are prohibited from sharing Your password with any third party. Regardless of the technology used, no security system is entirely impenetrable.

1.5. Confidentiality Efforts

Subject to Section 6 of this Policy, We continuously make our best efforts to maintain the confidentiality of Your information, documents, and Personal Data. Access to data is limited only to employees with legitimate business needs. We also conduct regular education and training on confidentiality and privacy, and implement physical, electronic, and procedural safeguards in accordance with applicable laws.

2. Collection of Information

2.1. Purpose of Collection

Beyondtech collects Your information, data, and documents (including Personal Data) to process transactions, manage and facilitate the use of our application and/or portal, and for other purposes permitted under applicable laws and regulations.

2.2. Types of Information Collected

a. Information You Provide

We require You to provide information during registration, including Business Entity documents and Personal Data of employees, directors, or representatives. This may include name, address, email, phone number, nationality, date of birth, financial information, transaction purposes, and photographs.

We assume that all information provided is accurate and lawful. Any losses resulting from inaccurate data shall be Your responsibility.

We may also request additional commercial or identification information for high-value transactions or to comply with anti-money laundering and counter-terrorism financing obligations.

If You provide Personal Data of a third party, You confirm that You have obtained consent from such party in accordance with this Privacy Policy.

b. Information Collected Automatically

This includes transaction details, geographic location, IP address, login data, browser type and version, operating system, platform, usage data, and customer service interaction history.

c. Information from Other Sources

We may receive information from third parties such as banks, payment service providers, business partners, analytics providers, and credit reference agencies.

d. Social Media Information

If You log in using a social media account, We may receive relevant profile information for the creation and management of Your account.

3. Cookies

Cookies are small files stored on Your device to save preferences and configurations when visiting a website. Cookies do not access other data on Your device without consent.

4. Use of Information

We use Your information and Personal Data to:

  • Provide services and fulfill contractual obligations;
  • Comply with legal and regulatory requirements;
  • Improve the quality, security, and effectiveness of our services;

5. Disclosure of Information

In accordance with applicable regulations, You have the right to request access to or correction of Your Personal Data. We may refuse such requests under conditions permitted by law.

7. Limitation of Liability

You are responsible for maintaining the confidentiality of Your credentials and Personal Data. We are not responsible for any data breach resulting from Your own actions or third parties outside Our system.

8. Data Storage Location

Your data may be stored, transferred, and processed in jurisdictions where We or Our service providers operate, subject to adequate protection measures.

9. Cross-Border Data Transfer

We may transfer data internationally by implementing appropriate technical, physical, and contractual safeguards in accordance with applicable data protection laws.

10. Profiling and Automated Decision-Making

We may use automated processes to improve services and prevent financial crime, without producing direct legal consequences for You.

11. Your Rights and Obligations

You have the right to access, correct, delete, transfer Your Personal Data, and withdraw Consent, provided such actions do not conflict with Our legal obligations.

12. Account Suspension and Termination

We may suspend or terminate accounts for legal, security, or compliance reasons.

13. Policy Changes

We may amend this Privacy Policy at any time and will notify You through our application and/or portal.

14. Governing Law and Dispute Resolution

This Privacy Policy is governed by the laws of the Republic of Indonesia. Any disputes shall first be resolved amicably. If no agreement is reached, disputes shall be settled through the South Jakarta District Court.

16. Statement and Consent

By agreeing to this Privacy Policy, You confirm that You have read, understood, and agreed to all provisions stated herein. If any provision is declared invalid or unenforceable, such provision shall be severed without affecting the validity of the remaining provisions.
