Privacy Policy

This Privacy Policy explains how we, Beyondtech or PT Adisena Mitra Usaha (hereinafter referred to as “We” or “Our” or “Us”), collect, store, use, process, control, transfer, disclose, and protect information and data related to users of Our services, including Personal Data, to the extent necessary.

As stipulated in the Beyondtech Service Agreement, Beyondtech’s services are provided to legal entities and business entities, whether incorporated under a specific deed or not (“Business Entities”). Accordingly, any information and data other than Personal Data covered by this Privacy Policy refer to information and data from Business Entities registered in Beyondtech’s electronic system, while Personal Data (as defined below) refers to Personal Data owned by employees or business representatives of such Business Entities.

This Privacy Policy is established in accordance with applicable laws and regulations, including but not limited to:

  • Law No. 27 of 2022 on Personal Data Protection,
  • Law No. 11 of 2008 on Electronic Information and Transactions, including its amendments, and
  • Relevant Government Regulations and Implementing Regulations.

By accessing and/or using Beyondtech’s services, the Business Entities and their employees or business representatives (hereinafter referred to as “You”) declare that all information, data, documents, and Personal Data You provide are true, complete, and valid. You also give consent to Beyondtech to obtain, collect, store, transfer, manage, and use such Personal Data as stipulated in this Privacy Policy, Service Agreement, and Beyondtech’s Terms and Conditions (“Consent”).

Your Consent remains in effect until You revoke it in writing or, subject to Article 13, upon termination of Your contractual relationship with Us.

DATA PROTECTION AND CONFIDENTIALITY

1.1

Definition of Personal Data

For the purposes of this Privacy Policy, “Personal Data” means information that identifies or can be used to identify, contact, or locate an individual or device associated with such information. Personal Data includes, but is not limited to:

  • Name, address, date of birth, occupation, phone number, email address;
  • Bank account details, credit card details, financial information;
  • Identification documents (such as ID card, passport, or other government-issued identifiers);
  • Photographs, nationality, vehicle information, and biometric data (including but not limited to facial recognition);
  • Your phone number and other contacts stored on Your mobile device.

This Personal Data applies to individuals who are employees or business representatives of the Business Entities using Beyondtech’s services.

1.2

Personal Data Security

We are committed to protecting the security of Your Personal Data by:

  • Storing Your Personal Data on secure servers;
  • Encrypting transaction payments using Transport Layer Security (TLS) technology.

However, You acknowledge that no security system is completely invulnerable to unauthorized access by third parties. Therefore:

  • You are responsible for maintaining the security of Your password;
  • Beyondtech shall not be liable for unauthorized access resulting from Your own negligence.

2.

COLLECTION OF INFORMATION

2.1

Types of Information Collected

Beyondtech collects information, data, and documents (including Personal Data) for the following purposes:

  • Processing user transactions within Beyondtech’s system;
  • Managing and improving service delivery;
  • Ensuring compliance with applicable laws, including regulations on anti-money laundering and counter-terrorism financing.

We collect information through:

  • Information You provide directly, such as names, addresses, financial data, and corporate documents.
  • Technical and transaction data, including IP addresses, browser details, and transaction history.
  • Data from third-party sources, such as financial service providers and regulatory authorities.
  • Information from social media, if You sign in to Our services using Your social media account (e.g., Google).

USE OF INFORMATION

We use Your data for:

  • Providing Beyondtech’s services to You;
  • Complying with legal and regulatory requirements;
  • Securing transactions and preventing fraud;
  • Analyzing service usage to enhance user experience.

We will not use Your Personal Data for other purposes without Your explicit consent.

4.

INFORMATION USAGE

4.1

We may use the information, documents, and Personal Data collected for the following purposes or any other purposes permitted by applicable laws and regulations (the “Purposes”):

  • a. To identify and register You as a user and to administer, verify, deactivate, or manage Your business account;
  • b. To facilitate or enable any necessary verification before We register You as a user or before We or Our payment service partners provide services to You, including conducting Know Your Business (KYB) and/or Know Your Customer (KYC) processes;
  • c. To process and facilitate orders and payment transactions made by You, including, where applicable, transactions conducted via payment cards or accounts available on Our application and/or platform;
  • d. To enable You to provide services to Your users, in cases where You offer services to third parties connected to Our platform;
  • e. To review and resolve user issues;
  • f. To contact You via email, mail, telephone, or other means, including but not limited to assisting with and/or resolving transaction processes and issues;
  • g. To monitor or investigate suspicious transactions or those suspected of containing elements of fraud or violations of the Service Agreement and/or Terms and Conditions, as well as applicable laws, and to take necessary actions as a follow-up to such monitoring or investigation results;
  • h. To process and respond to inquiries and feedback received from You;
  • i. To maintain, develop, test, improve, and personalize the application and/or platform to meet Your needs and preferences;
  • j. To monitor and analyze user activity, behavior, and demographics, including habits and usage of various services available on the application and/or platform;
  • k. To offer or provide services from Our affiliates or payment service partners (as applicable); and
  • l. To send direct or targeted marketing communications, advertisements, vouchers, surveys, and information about special offers or promotions to You.

4.2

If We are required to collect information, documents, and Personal Data based on legal obligations or other contractual provisions binding between You and Us, and You choose not to provide such information, documents, and Personal Data, or provide incomplete information, We reserve the right not to provide Our services to You. This shall not be considered a breach of contract, and You agree to release Us from any claims, demands, or lawsuits related to this matter.

5.

DISCLOSURE OF INFORMATION

5.1

We may share Your information with selected third parties, including:

  • a. Affiliates, payment service partners, business partners, suppliers, vendors, and subcontractors for the fulfillment and/or execution of contracts made with them or with You, including for the provision of services, KYB and KYC verification, and transaction monitoring;
  • b. Financial institutions, banks, debt collection agencies, and credit agencies for the following purposes:
  • i. Compliance with credit card association rules regarding terminated users;
  • ii. Compliance with anti-money laundering and counter-terrorism financing regulations;
  • iii. If We believe that disclosure of Your information is necessary to prevent fraud or to assess and manage operational or financial risks;
  • c. Law enforcement agencies, regulators, government officials, or other third parties in accordance with subpoenas, court orders, investigative or official document disclosure requests, regulatory notices, or any other legal processes or requirements applicable to Us or any of Our payment service partners or affiliates. We may also disclose Personal Data if We, at Our sole discretion, believe such disclosure is necessary to prevent financial losses, report suspected illegal activity, or investigate violations of Our Service Agreement and Terms and Conditions;
  • d. Advertisers and advertising networks solely to select and provide relevant advertisements to You and others;
  • e. Analytics providers and search engine operators who assist Us in improving and optimizing Our platform;
  • f. Our group entities or subsidiaries; and
  • g. Entities involved in mergers, acquisitions, financing transactions, or joint ventures with Us.

5.2

We may disclose Your information, documents, and Personal Data to third parties in the following circumstances:

  • a. In the event of a sale or acquisition of any business or assets, where We may disclose Your Personal Data to the prospective buyer or seller of such business or assets;
  • b. If required to disclose or share Your information, documents, or Personal Data to comply with any legal obligation, investigation, or enforcement of an agreement, or to protect the rights, property, or safety of Beyondtech, Our customers, or others. This includes exchanging information with other companies and organizations for fraud prevention and credit risk reduction;
  • c. To assist Us in conducting or cooperating in investigations of fraud or other illegal activities where We believe such action is warranted and appropriate;
  • d. To prevent and detect fraud and criminal activities;
  • e. In response to legal processes, including subpoenas, court orders, and government demands;
  • f. To assess financial and insurance risks;
  • g. For debt recovery or matters related to bankruptcy; and
  • h. To develop customer relationships, services, and systems.

6.

ACCESS AND CORRECTION OF PERSONAL DATA

6.1

Subject to applicable laws and regulations, You may request access to and/or correction of the information, documents, and Personal Data that We control or manage by contacting Us through the details provided below.

6.2

We reserve the right to refuse Your request to access or correct Personal Data, in whole or in part, if permitted or required by law. This includes situations where the information, documents, or Personal Data may contain references to other individuals, or where We determine that the request is irrelevant, unsubstantiated, or disruptive.

6.3

For the avoidance of doubt, We are not obligated to grant access to or correct business entity-related information and documents unless such information pertains specifically to Personal Data and is permitted under the law.

LIMITATION OF LIABILITY

7.1

You are responsible for maintaining the security of Your information, documents, and Personal Data, including:

  • Restricting access,
  • Creating strong passwords,
  • Regularly updating passwords, and
  • Securing One-Time Passwords (OTP).

7.2

We shall not be liable for any exchange or disclosure of Your Personal Data that You initiate independently, including those conducted through Our application and/or platform. By continuing to use Our services, You waive any claims, losses, demands, or lawsuits arising from Your own negligence or that of Your business representatives in safeguarding the security and confidentiality of Your Personal Data, or due to unauthorized third-party access.

Our platform may contain links to third-party platforms. Please note that We do not control these third-party platforms, and You acknowledge that We are not responsible for their privacy policies. We recommend that You review the privacy policies of each platform You visit.

7.4

We are only responsible for protecting and securing Your Personal Data stored within Our systems. We take reasonable and necessary measures to ensure the security and confidentiality of Your Personal Data.

7.5

We do not guarantee the authenticity, accuracy, completeness, or validity of the information, documents, and Personal Data provided by You.

8.

LOCATION OF PERSONAL DATA

The information, documents, and Personal Data collected from You will be managed, transferred, and stored in the jurisdiction where We obtain such information, documents, and Personal Data, as regulated by applicable law. By submitting Your information, documents, and Personal Data, You consent to such transfer, storage, and processing.

We will take all necessary measures to ensure that Your data is securely managed in accordance with this Privacy Policy. We may also retain Your information, documents, and Personal Data for as long as We deem necessary to comply with the Purposes, the requirements of this Privacy Policy, or any applicable legal obligations.

JURISDICTION AND CROSS-BORDER DATA TRANSFER

9.1

To provide Our services to You, it may be necessary for Us to transfer Your data to Our partners located outside the jurisdiction where We collect Your information, documents, and Personal Data. In such cases, We ensure that We and Our partners implement adequate technical, physical, and organizational security measures to protect Your data. Furthermore, We will maintain appropriate contractual safeguards with such third parties.

We may store and process Your information, documents, and Personal Data in any country where We operate or where We engage service providers. Your data may be transferred to a country outside of Your jurisdiction, which may have different data protection regulations than Your country of origin. However, We will take necessary steps to ensure that such transfers comply with applicable data protection laws and that Your information, documents, and Personal Data remain protected in accordance with this Privacy Policy.

In certain circumstances, courts, law enforcement agencies, regulatory authorities, or security agencies in other jurisdictions may be entitled to access Your information, documents, and Personal Data.

PROFILING AND AUTOMATED DECISION-MAKING

10.1

We may use certain data to personalize Our services and the information We provide to You, tailoring them to meet Your needs—such as based on Your country of residence or transaction history. For example, if You frequently send money from one currency to another, We may use this information to notify You of new product updates or relevant financial tools that may benefit You.

In doing so, We will take all reasonable measures to ensure that Your privacy and security remain protected.

10.2

As part of a highly technical and innovative organization, We may use Automated Decision-Making (ADM) to enhance Your experience and combat financial crimes. For instance, to provide You with fast and efficient service, We may use ADM to verify Your identity documents or confirm the accuracy of the information You provide to Us. However, no ADM process undertaken by Us will have legal consequences or significant impact on You.

11.

YOUR RIGHTS AND OBLIGATIONS

11.1

You have the right to opt out of marketing communications by contacting Us via the contact information provided in this Privacy Policy or by adjusting Your notification preferences.

11.2

You are responsible for correcting any inaccurate, incorrect, or outdated information, documents, and Personal Data that We hold about You.

11.3

You also confirm that You have the legal right to share all information provided to Us and grant Us the right to use, modify, and/or delete any incorrect or inconsistent data You have submitted.

11.4

You have the right to request Us to stop collecting, using, disclosing, and/or deleting Your Personal Data when it is no longer needed or is no longer subject to any legal obligations binding Beyondtech. You may also revoke Your Consent (partially or fully) at any time by submitting a written request through the contact details provided in this Privacy Policy.

Upon receipt of Your request, We will inform You of the consequences of such revocation, and We will cease collecting, using, and disclosing Your Personal Data in accordance with this Privacy Policy.

Notwithstanding the above, You agree that We may continue to use and disclose Your information, documents, and Personal Data for the Purposes, for a reasonable period after the termination of Your contractual relationship with Us.

11.5

You have the right to transfer Your Personal Data between data controllers, such as migrating Your business account details from one online platform to another.

11.6

Our services may, from time to time, contain links to and from third-party websites, partners, advertisers, and affiliates. If You follow any of these links, please note that such websites have their own privacy policies, and We do not accept any responsibility for them. You should review their policies before providing Your Personal Data.

12.

ACCOUNT TERMINATION AND BLOCKING

12.1

At Your request, We will close Your business account and suspend Your use of Beyondtech services. Additionally, if We determine that there are risks or circumstances that may harm Us or You, We may proceed with blocking Your account. Nevertheless, We will provide You with an appeal mechanism as set out in this Privacy Policy.

12.2

Your business account may be blocked under, but not limited to, the following circumstances:

  • a. A report indicating that Your account has been stolen or compromised;
  • b. A blocking order issued by a government or monetary institution, or pursuant to a court order;
  • c. Use of Your business account and/or Beyondtech services in a manner that violates this Privacy Policy, Beyondtech’s Service Agreement, Beyondtech’s Terms and Conditions, or applicable laws and regulations;
  • d. Other activities that may harm You or Us, including fraudulent or abusive behavior or transactions flagged as suspicious by Our system.
  • e. If Your business account is blocked and You can provide valid proof that no suspicious activity has occurred, You may file an appeal as outlined in Beyondtech’s Service Agreement and Terms and Conditions. After reviewing Your appeal, We will decide whether to maintain or lift the account block. The block will not be unreasonably prolonged if We determine that the issue causing the block has been resolved.

12.3

Your business account may be closed under the following conditions:

  • a. Upon Your request, provided no transactions have been made. If transactions have been made, Your account will be marked as “unverified” but cannot be closed, as regulations require account data retention for five (5) years;
  • b. At Our discretion, based on applicable laws and regulations;
  • c. If force majeure conditions persist for three (3) months or longer; and/or
  • d. Other reasons related to account blocking.
  • e. Any remaining funds in Your account will be returned via a mutually agreed method, after deducting any outstanding fees (if applicable), except where We determine that fund retention is necessary due to suspected fraudulent activities or legal violations.
  • f. Your business account will be automatically terminated or closed when You close Your account.

13.

CHANGES TO OUR PRIVACY POLICY

13.1

We reserve the exclusive right to modify, amend, or revise this Privacy Policy from time to time.

13.2

Any changes made to this Privacy Policy will be published on the Beyondtech application and/or platform and will be duly notified to You via in-app notifications. You are encouraged to regularly review this Privacy Policy for updates or modifications.

14.

MISCELLANEOUS

14.1

This Privacy Policy is governed by, executed under, and interpreted in accordance with the laws of the Republic of Indonesia.

14.2

Any disputes arising between You and Us in relation to this Privacy Policy and the provision of Our services shall be resolved at the administrative office of the West Jakarta District Court. However, both parties agree to make every effort to resolve disputes amicably.

If any provision or part of this Privacy Policy is deemed unlawful, unenforceable, or invalid, such provision or part shall be deemed removed from this Privacy Policy, and We will adjust the relevant provision to ensure compliance while maintaining the effectiveness of the remaining terms of this Privacy Policy in full force and effect.
